Interstice.cloud ("us", "we", or "our") provides an image generation service. It consists of a website (https://www.interstice.cloud) and an online service which can be used through a Krita Plugin ("krita-ai-diffusion"). This policy applies to both the website and any services provided through the plugin, collectively called "Service". It explains how we collect, use, disclose, and protect information across the Service, and your choices about the collection and use of your information.

Krita is a third-party painting application. It is not subject to this policy and not in any way affiliated with Interstice.cloud. The Krita Plugin ("krita-ai-diffusion") may be used offline in which case no information is exchanged or collected. It may also be used with other third-party services, in which case their respective privacy policies apply.

2. Information we collect

We collect the following types of information about you:

a)Information you provide us directly

We may collect information when you create an account, such as a unique customer ID or an email address. We also collect any messages when you communicate with us, such as requesting information about our Services or request customer or technical support.

b)Information we collect automatically

We may collect personal information automatically when you use our Services:

Automatic data collection when you visit our website.
We may collect certain information automatically when you use our Services, such as your Internet protocol (IP) address, user settings, MAC address, cookie identifiers, browser or device information, location information (including approximate location derived from IP address), and Internet service provider. We may also automatically collect information regarding your use of our Services, information about the links you click, the types of content you interact with, the frequency and duration of your activities, and other information about how you use our Services.
Automatic data collection when you use the plugin.
We may collect other types of technical information about your use of our Services, such as performance metrics. None of this technical information is connected with your personal information or Customer Data and is only used to improve our Services.
Cookies.

We use cookies only for essential purposes, such as to authenticate you and to remember your preferences. However, the Service may not function properly if the ability to accept cookies is disabled.

c)Information collected from other sources

We may obtain information about you from third-party login services that you have made available via your privacy settings. You may unlink your third party account from the Service by adjusting your settings on the third party service. If you unlink your third party account, we will no longer receive information collected about you in connection with that service.

We use the information we collect about you for the purposes set out below:

a)To provide our Services

We use the information that you directly give us to provide the Service to you. This includes allowing you to sign in and operate the Service, and billing you for transactions that you make via the Service. We also use information we collect about you automatically to remember information about you so that you will not have to re-enter it during your visit or the next time you visit the site.

b)For Service improvement

We use the information we collect automatically to analyze how you interact with our Service so that we can improve the Service. This includes image generation parameters (such as resolution and quality), but not images themselves, nor any text descriptions (prompts) you provide.

We use your contact information to get in touch with you and to send communications about critical elements of the Service. For example, we may send you emails about technical issues, security alerts or administrative matters.

d)For matters that you have specifically consented to

We may use personal information for other purposes that are clearly disclosed to you at the time you provide personal information or with your consent.

We will use or disclose your information where it is necessary to comply with the law and the reasonable requests of law enforcement.

4. How we share your information

a)Third-party service providers

We may share your information with authorized third-party service providers who perform services and functions on our behalf to support our interactions with you. We may use third-party Application Program Interfaces ("APIs") and software development kits ("SDKs") as part of the functionality of our Services. The kinds of services that we may use include: hosting, authentication and payment processing.

b)Business transactions

If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction, as permitted by law and/or contract.

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. We have taken appropriate safeguards to require that your personal information will remain protected and require our third-party service providers and partners to have appropriate safeguards as well. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized disclosure.

Your personal information is stored in Germany, EU. Information required to generate and process images may be transferred and processed by us in other countries in Europe, Canada or the US, which may have data protection laws that are different from the laws where you live.

b)How long we keep your information

We store the personal information we collect as described in this Privacy Policy for as long as you use our Services or as necessary to fulfill the purpose for which it was collected, provide our Services, resolve disputes, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

8. Additional information for users in Europe

This section of the policy applies if you are located in the European Economic Area (EEA), Switzerland or United Kingdom (UK). We processes your personal data in accordance with European laws and regulations, such as the General Data Protection Regulation (GDPR) and UK General Data Protection Regulation (UK GDPR).

We process your personal data on the following legal bases:
